1. Agreement

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “you”) and Libriate, a trading name of Bluberrie Digital Ltd (“Company”, “we”, “us”), a company registered in England & Wales, trading as DomainOps. By creating an account or using the DomainOps service, you agree to be bound by these Terms and our Privacy Policy.

If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity.

2. Service description

DomainOps is a software-as-a-service (SaaS) platform that provides domain monitoring, endpoint liveness testing, and exposure scanning. The service monitors domain registrations, SSL certificates, DNS configurations, endpoint availability, and security exposures on your behalf.

3. Account responsibilities

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your credentials.
  • You must notify us immediately of any unauthorised use of your account.
  • You are responsible for all activity that occurs under your account.

4. Acceptable use

You agree not to:

  • Use the service to monitor domains or endpoints you do not own or have authorisation to monitor.
  • Attempt to gain unauthorised access to our systems or other users' accounts.
  • Use the service for any illegal purpose or in violation of applicable laws.
  • Resell, sublicence, or redistribute the service without our written consent.
  • Interfere with or disrupt the integrity or performance of the service.

5. Data ownership

You retain all ownership rights to the domain data, endpoint configurations, and other information you provide to the service. We do not claim ownership of your data. We process your data solely to provide the service as described in our Privacy Policy.

6. Fees and billing

Certain features of DomainOps require a paid subscription. Fees are billed in advance on a monthly or annual basis as selected at checkout. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice.

7. Limitation of liability

To the maximum extent permitted by applicable law:

  • Our total aggregate liability arising out of or relating to these Terms or the service shall not exceed the total fees paid by you in the twelve (12) months immediately preceding the event giving rise to the claim.
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill.
  • We shall not be liable for any failure to detect domain expirations, SSL issues, endpoint failures, or security vulnerabilities. The service is provided as an aid to monitoring, not a guarantee.

8. Disclaimer of warranties

The service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, secure, or that defects will be corrected.

9. Indemnification

You agree to indemnify, defend, and hold harmless Bluberrie Digital Ltd (trading as Libriate), its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the service, your violation of these Terms, or your violation of any third-party rights.

10. Termination

Either party may terminate these Terms at any time. You may cancel your account through the account settings. We may suspend or terminate your access if you breach these Terms. Upon termination, your right to use the service ceases immediately. You may export your data before termination. We will delete your data within 30 days of account deletion, except as required by law.

11. Changes to these Terms

We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of material changes via email or in-app notification. Your continued use of the service after the effective date of the revised Terms constitutes your acceptance of the changes.

12. Governing law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
